Vendor Premium Payment Assistance, LLC (“VPPA” or “we”) recognizes that individuals need to understand how their privacy is protected, so we have established the following privacy statement (this “Privacy Statement”) for our users. This Privacy Statement describes how VPPA will collect, access, use and disclose your personal information and information related to your use of the Website.
For purposes of this Privacy Statement, “Personal Information” is data specifically about you, which you typically provide on a voluntary basis. Aggregate or combined information includes data that is related to you but studied as a group and does not identify you specifically. You cannot “opt-out” from having aggregate information collected except as otherwise specified in this Privacy Statement.
II. INFORMATION COLLECTED BY VPPA
In order to provide you with the benefits of using the Website, including utilizing the vendor portal on the Website (the “Portal”) in order to participate in the applicable state vendor payment program (the “Payment Program”), among other uses, VPPA collects certain information from you and your devices and from third party sources. By using the Website or otherwise providing Personal Information to VPPA, you consent to VPPA’s collection, use and sharing of the data as described in this Privacy Statement.
1. Information that You Provide to VPPA
When you register for an account for the Portal, use the Portal, complete forms (including offline), communicate with us (including offline), or subscribe to newsletters or other communications from us, you provide certain Personal Information to VPPA, including but not limited to your name, company name, contact information, tax ID or business EIN number, other related tax information (e.g., federal Form W-9), driver’s license, and bank account information.
2. Information Collected from Third Party Sources
In addition to the information that you provide to VPPA, we may collect certain Personal Information about you from third party sources. Such sources may include publicly available information provided by the government (e.g., by a state government) and information provided by third party aggregators of public information (e.g., Dunn and Bradstreet).
3. Information Collected by the Website
In addition to the information that you provide to VPPA and that we collect from third party sources, the Website will automatically gather and store certain information about your visit, such as your IP address, time and date of your visit, your browser type, and the VPPA webpages that you visit (“Website Data”). None of the Website Data that is automatically collected is deemed to be Personal Information.
We may collect this information through the use of cookies (including tracking cookies and Flash cookies), web beacons, browser information, and log files.
III. USE AND SHARING OF COLLECTED INFORMATION
1. General
VPPA may use your Personal Information and Website Data (collectively, the “Collected Information”) to provide you with the Website (including the Portal), verify your identity and information required to purchase receivables under the Payment Program, enable you to participate in the Payment Program (including to process your payments and other transactions), for troubleshooting and maintenance, to communicate with you about your account, to update your account, for internal verification and administrative purposes, to conduct statistical analysis and market research, and to offer you services or other opportunities. We may also use your Collected Information for the uses identified in any agreements you may have with us, including but not limited to a Vendor Assignment Agreement, as applicable. Such uses may include identifying and quantifying any state offsets, reporting payment to taxing bodies, obtaining a credit report, and investigating and preventing fraud, among other identified uses. If you provide Personal Information to VPPA, or use or access the Website or Portal, you consent to the use, collection and disclosure of the Collected Information by VPPA for the purposes described in this Privacy Statement.
VPPA may share certain Collected Information (including Personal Information) with the applicable state government and other required third parties in order for you to participate in the applicable Payment Program. VPPA may also share Collected Information (including Personal Information) with our affiliates and third parties acting on our behalf, such as call center operators, consultants, service providers, data analytics providers, etc. VPPA may share Website Data with non-affiliated third parties without your consent (including for the reasons listed below), but VPPA will not sell or share your Personal Information with non-affiliated third parties for their own marketing purposes without your consent. If VPPA is involved in any merger, acquisition, sale of company assets, transition of service to another provider, or insolvency, bankruptcy or receivership, we reserve the right to transfer your Personal Information in connection with such transaction. Also, VPPA may disclose your information (including your Personal Information) as necessary (1) if we determine a Website or policy violation has occurred, or to enforce the Payment Program terms or the VPPA Terms of Use; (2) if we believe such disclosure is necessary to identify, contract or bring legal action regarding injury or interference with the rights and property of VPPA, including to enforce VPPA’s rights against unauthorized access or attempted unauthorized access to VPPA’s information technology assets or against other inappropriate use of the Website, the Portal or the Payment Program; (3) to comply with laws, regulations, court orders and subpoenas or similar requests for information by authorities, or as otherwise required by law; (4) to protect your safety and the safety of others; and (5) to assist us in fraud prevention or investigation.
2. Aggregated Data
VPPA may aggregate the Website Data it collects from its various users (which does not include your Personal Information) and share it with VPPA’s affiliates, business partners and other third parties. The aggregated data may be used by VPPA or the third parties for statistical analysis, for research purposes, to improve the Website and services, to meet reporting requirements with government entities, among other uses.
3. Website Data
In addition to the uses described above, VPPA may use Website Data to improve the Website and to help VPPA understand how users are using the Website. This information is also collected for statistical analysis, to determine what information is of most and least interest to our users, to improve the utility of the Portal and the Website, and for other purposes described in this Privacy Statement.
IV. ACCESS, REVIEW AND CORRECTION OF PERSONAL INFORMATION
You may access, review, correct and update certain Personal Information (such as your name and contact information) by signing in to your account on the Portal and editing your Personal Information in your account profile.
V. OPTING-OUT
1. Opting-Out of Marketing Communications
You may also receive email communications from VPPA, including communications regarding the Portal, the Payment Program, marketing or promotions, and/or other topics. To contact you, VPPA may use the information you provide to us, including email, address, fax or phone. You may, at any time, inform us that you do not want VPPA to contact you for marketing purposes by sending your request to us using the contact information in the “Contact Us” section below. You may also opt-out of promotional email communications by clicking on a link provided in the promotional email message. After opting-out, you will no longer receive marketing or promotional communications but will continue to receive other messages, such as emails relating to your participation in the Payment Program.
2. Opting-Out of Aggregated Uses
As described above, VPPA may use your information (including Personal Information and Website Information) in an aggregated manner for statistical analysis and research purposes. You may inform us that you do not want VPPA to use your information for such purposes by sending your request to us using the contact information in the “Contact Us” section below. After opting-out, we will no longer include your information for our statistical analysis and research purposes; however, we may still share your information (including in aggregated format) to comply with reporting and other legal requirements (e.g., with government entities) and as otherwise described in this Privacy Statement.
VI. TRACKING; THIRD-PARTY ANALYTICS AND REMARKETING PROVIDERS
1. Do Not Track Disclosure
Certain web browsers may provide a do-not-track (“DNT”) option. You may be able to ask your browser to inform websites that you do not wish your activities to be tracked, either with cookies or other persistent identifiers, commonly called “DNT signals.” The Website currently responds to DNT signals.
2. Third-Party Analytics and Remarketing Providers
We use Google Analytics to learn more about the types of users that visit the Website and to help improve the Website. Google Analytics provides us with certain data regarding the demographics of the users that visit the Website. We also work with third-party remarketing providers, including Google AdWords Remarketing and similar providers, to help us advertise online and remarket to individuals who visit the Website. These third-party remarketing providers allow us to show our ads on various sites across the Internet, and in some cases, tailor our ads (using dynamic remarketing and cookies and/or device identifiers) to individuals who have previously visited the Website. VPPA is committed to maintaining the security of the data you provide us. However, please note that there is always some risk in transmitting information over the Internet. Because the Website is provided through the Internet, when you use the Website, your communications may be intercepted by others. For this reason, VPPA cannot guarantee the security and privacy of transmissions via the Internet, and we will not be liable for any lack of security relating to the use of the Website by you. You agree that you will not hold VPPA liable for any damages resulting from any loss of privacy or security occurring in connection with any communications over such networks.
VIII. EXCLUSIONS
The Website may contain links to websites owned by other companies. Because VPPA has no control over the privacy practices or content of these linked sites, we recommend that you carefully review the privacy statement of each website you visit. VPPA is not responsible for the content or privacy practices of websites owned by other companies. In addition, this Privacy Statement applies only to information provided by or collected from customers and users in the United States and is not intended to describe data handling procedures for information collected by other linked websites or business partners.
This Privacy Statement addresses VPPA’s procedures for handling the Personal Information of customers in the United States whom are at least 13 years old. We do not seek to, nor do we knowingly collect, information from children. If a child has provided us with Personal Information, a parent or guardian of that child may contact us to have the information deleted from our records.
